Introduction and Acceptance of Terms

Welcome to Kefilo,

These Terms of Use and Services (“Terms”) governs your access to and use of the Kefilo’s website and application (the “Platform”) and all associated products, meal plans, nutritional content, health programmes, gym partner integrations, and any other features offered by Kefilo (collectively, the “Services”). These terms apply uniformly across all access channels including the website and mobile applications unless expressly stated otherwise. Kefilo is a health and nutrition food delivery brand committed to delivering personalised, nutrition-first meals designed to support your health, fitness, and wellness goals. We serve 500+ customers across India and partner with 10+ gyms to bring integrated wellness solutions to our community.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE PLATFORM. BY ACCESSING, BROWSING, REGISTERING, OR PLACING AN ORDER ON THE PLATFORM, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE, PLEASE DO NOT USE THE PLATFORM OR SERVICES.

These Terms, read together with the Privacy Policy available at www.kefilo.com/privacy-policy, form a binding legal agreement between you ("User", "you", or "your") and Kefilo ("Kefilo", "we", "us", or "our"). Terms used but not defined herein shall have the meaning assigned to them in the Privacy Policy.


Definitions

For the purposes of these Terms, the following definitions shall apply:

  • "Platform" means the Kefilo ecosystem including :

    • Website (www.kefilo.com) including all web pages, features, content, and tools available thereon,

    • Mobile applications (Android, iOS)

    • Smart devices, vending systems, IoT-enabled infrastructure

    • APIs, partner dashboards, and software tools

    • Any related digital or physical interface through which Services are provided

  • "Services" means all products, meal plans, nutritional guidance, health programmes, gym partner integrations, subscriptions, delivery services, and any other offerings made available by Kefilo through the Platform.

  • "User" or "you" means any natural or legal person who accesses or uses the Platform or Services, including registered and unregistered visitors, customers, and subscribers.

  • "Order" means a confirmed purchase or booking of a meal, meal plan, subscription, or any other product or service placed by a User on the Platform.

  • "Meal Plan" means a personalised or pre-designed combination of meals and nutritional products curated to meet specific dietary and health objectives.

  • "Partner" means any fitness centre, gym, wellness studio, health institution, hospital, school or any other institute that has entered into a partnership agreement with Kefilo to offer integrated wellness benefits to their members.

  • "Content" means all text, graphics, images, photographs, videos, nutritional information, recipes, articles, and other materials available on the Platform.

  • "Intellectual Property Rights" means all patents, copyrights, trademarks, service marks, trade secrets, and any other proprietary rights recognised under Indian law.

  • "Force Majeure Event" means any event beyond the reasonable control of Kefilo, including acts of God, government actions, pandemics, floods, earthquakes, cyberattacks, or breakdown of telecommunications infrastructure.


Eligibility and User Representations

By using the Platform, you represent and warrant that:

  1. You are at least 18 (eighteen) years of age and competent to contract within the meaning of the Indian Contract Act, 1872;

  2. You are using the Platform for lawful purposes only and in compliance with these Terms and all applicable laws of India;

  3. All information you provide to us is accurate, complete, and current;

  4. You are not prohibited from receiving Services under Indian law or any jurisdiction applicable to you;

  5. You will not use the Platform for any commercial resale or redistribution of our products without our prior written consent.

If you are accessing the Platform on behalf of a business entity, you further represent that you have the authority to bind such entity to these Terms, and "you" shall refer to such entity.

Kefilo reserves the right to refuse access to the Platform or terminate your account if it determines, at its sole discretion, that you do not meet the eligibility criteria set out above.


Account Registration and Security

4.1 Registration

To access certain features of the Platform, including placing Orders and accessing personalised meal plans, you may be required to register for an account. You agree to:

  • Provide accurate, truthful, and complete information during registration;

  • Keep your account information updated at all times;

  • Not register using a false identity, impersonate any person, or create an account for anyone other than yourself without proper authorisation;

  • Maintain only one active account on the Platform at any time.


4.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials (username and password). You agree to:

  • Not share your account credentials with any third party;

  • Immediately notify Kefilo of any unauthorised access to or use of your account;

  • Ensure you log out from your account after each session, especially when using shared devices.

Kefilo shall not be liable for any loss or damage arising from unauthorised access to your account resulting from your failure to safeguard your credentials. Any action taken through your account credentials shall be deemed to have been authorised by you.


4.3 Account Suspension and Termination

Kefilo reserves the right to suspend or terminate your account, at its sole discretion and without prior notice, if:

  • You breach any provision of these Terms;

  • You provide false or misleading information during registration;

  • Your conduct is found to be harmful, fraudulent, or abusive towards Kefilo, its staff, or other users;

  • You engage in any activity that violates applicable Indian law.

Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature survive termination shall continue to apply.


4.4 Mobile Application & License

Kefilo grants you a limited, non- exclusive, non- transferrable, revocable license to use its mobile application. You shall not reverse engineer, copy, or modify the app or use the app for commercial exploitation. Your use of the app is also subject to Apple App Store / Google Play policies.

Users downloading the mobile app from third- party app stores acknowledge that such platforms are not parties to this agreement and have no responsibility for the Services. Kefilo is also not responsible for device incompatibility and OS related issues.


Description of Services

5.1 Meal Delivery Services

Kefilo offers personalised, nutrition-first meal delivery services designed to support a variety of health goals including healing, energy management, performance, and foundational wellness.

Our Platform allows you to:

  • Browse and select from 50+ menu items across 10+ food categories, including both vegetarian and non-vegetarian options;

  • Subscribe to customised Meal Plans based on your health objectives, dietary preferences, and fitness routine;

  • Place single or recurring Orders for delivery to your specified address. Kefilo partners with gyms, fitness centres, hospitals, educational institute and other institutes across India to offer integrated nutrition and wellness services to their members. If you access Kefilo's Services through a Partner programme:

  • Your eligibility for benefits under the programme is subject to your active membership with the relevant Gym Partner or other institute;

  • Kefilo acts solely as a nutrition and meal service provider and is not responsible for the partner's services, facilities, or membership terms;

  • Any benefits, discounts, or special offerings under the partnership are subject to the specific terms communicated to you at the time of enrolment.

  • Kefilo is not responsible for medical advice from hospitals and fitness guidance from gyms. Data may be shared between Kefilo and partners with consent, QR- based or integrated services are provided on an ‘ as is’ and ‘ as available’ basis.


5.2 Service Availability

Kefilo endeavours to make the Platform and Services available at reasonable times. However, we do not guarantee uninterrupted or error-free access to the Platform. Services may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control. We shall provide reasonable advance notice of planned downtime where feasible.

Delivery services are currently available in select cities and localities in India. Serviceability of a particular address shall be confirmed at the time of placing an Order. Kefilo reserves the right to modify, suspend, or discontinue Services in any area at any time.

Kefilo may provide AI-generated meal plans, Gut-health insights, Mood-based recommendations. These are based on user inputs and algorithms and for informational purposes only. Kefilo does not guarantee accuracy, medical suitability and health outcomes. Users must verify recommendations independently and consult professionals where required.


5.3 Location-Based Services

By using the Platform (including the mobile application), you expressly consent to Kefilo accessing, collecting, and processing your real-time and/or approximate location data, subject to your device permissions. Your location data may be used for the following purposes,

• Determining service availability in your area

• Enabling accurate delivery and logistics coordination

• Providing real-time order personalising meal plans or recommendations based on regional availability

• Improving operational efficiency and user experience

You may enable or disable location services at any time through your device settings. However, you acknowledge that disabling location access may impact delivery accuracy, limit access to certain features, and affect service availability detection. Kefilo does not guarantee the accuracy of location data due to device limitations, network issues, and third-party GPS providers.

Kefilo shall not be liable for incorrect deliveries arising from inaccurate location data or delays caused due to location-related errors. Location data shall be processed in accordance with Kefilo’s Privacy Policy and retained only for as long as necessary for service delivery and legal compliance.


Technology Operations, Data Usage & User Communications

6.1 Communication & Notifications

By registering on the Platform, you expressly consent to receive communications from Kefilo through push notifications (mobile application), SMS, WhatsApp messages, and email. The types of communication you may receive include:

• Transactional / Service Communications (Mandatory)

  • Order confirmations and updates

  • Delivery status notifications

  • Payment confirmations

  • Account-related alerts

  • Customer support responses

These communications are essential for service delivery and cannot be opted out of while using the Platform.

• Promotional / Marketing Communications (Optional)

  • Offers, discounts, and campaigns

  • New product or feature launches

  • Health tips, nutrition insights, and wellness content

  • Partner promotions

You may opt out of marketing communications at any time by clicking “unsubscribe” in emails, updating notification preferences in the application, or contacting customer support. However, you will continue to receive essential transactional communications.

Kefilo may use third-party service providers, such as SMS gateways, email platforms, and messaging APIs, to send communications. Kefilo shall not be liable for delays or failures caused by such third-party communication services.

Where applicable, Kefilo shall comply with Telecom Regulatory Authority of India (TRAI) regulations. However, you may still receive transactional messages even if Do Not Disturb (DND) services are activated. You are responsible for providing accurate contact details and keeping your information updated. Kefilo shall not be liable for missed communications due to incorrect or outdated information.


6.2 Application Updates & Version Control

Kefilo reserves the right to modify, update, upgrade, or discontinue the mobile application or any part of the Platform at any time, including introducing new features, functionalities, or technical requirements. Such updates may be automatic or may require manual installation by the user. Certain updates may be mandatory for security enhancements, bug fixes, or feature compatibility. You agree that failure to install updates may result in limited functionality or inability to access the Services.

Kefilo does not guarantee that older versions of the application will remain functional or compatible and shall not be liable for service disruptions caused due to outdated versions or incompatibility with your device, operating system, or third-party software.

The performance of the application may depend on device specifications, operating system versions, and network connectivity. Kefilo does not guarantee error-free operation across all devices or configurations. Kefilo also reserves the right to modify or discontinue any feature, functionality, or service without prior notice, where reasonably required, and shall not be liable for any loss arising from such modification or discontinuation.


6.3 Data Analytics, Insights & AI Usage

Kefilo may collect and use aggregated, anonymised, and non-identifiable data derived from user activity on the Platform for purposes including improving products and services, enhancing user experience, operational analytics, performance optimisation, business intelligence, and strategic decision-making. Kefilo may use such anonymised data to train, test, and improve AI-based recommendation systems, meal planning algorithms, gut-health and nutrition models, and to develop predictive insights and personalisation engines.

All data used under this clause shall be anonymised and stripped of personally identifiable information (PII). Kefilo shall not sell personally identifiable user data to third parties without explicit consent. Kefilo may use anonymised data for internal research and development and may collaborate with research institutions, partners, or technology providers, provided that no individual user can be identified.

Where data is shared, it shall be aggregated and anonymised and shared only for legitimate business, research, or technological purposes, subject to applicable data protection laws. User rights relating to personal data, including access, correction, and deletion, shall be governed by Kefilo’s Privacy Policy and applicable laws, including the Digital Personal Data Protection Act, 2023.


Orders and Order Processing

7.1 Placing an Order

To place an Order, you must have a registered account and provide accurate delivery address and contact details. By submitting an Order, you make an offer to purchase the selected products or services at the prices displayed on the Platform.

Your Order shall be considered accepted and confirmed only upon receipt of a written confirmation from Kefilo via email or SMS or both. Kefilo reserves the right to accept or reject any Order at its discretion, including in cases of:

  • Unavailability of a product or meal item;

  • Delivery address falling outside the serviceable zone;

  • Suspected fraudulent or unauthorised transaction;

  • Inability to contact you on the registered mobile number.


7.2 Pricing and Taxes

All prices displayed on the Platform are in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST) unless stated otherwise. Prices are subject to change without prior notice and the price applicable to your Order shall be the price displayed at the time of Order placement.

Any delivery charges, packaging fees, or platform convenience fees, if applicable, shall be disclosed separately before final checkout. Kefilo shall not be liable for any additional bank charges, transaction fees, or currency conversion charges incurred by you in relation to payments.


7.3 Order Modifications

Once an Order is placed and confirmed, modifications may not be possible as meal preparation begins promptly. If you need to modify your Order, please contact our customer support immediately. Kefilo shall make reasonable efforts to accommodate modification requests but does not guarantee the ability to do so after confirmation.


Cancellations, Refunds, and Returns

8.1 Cancellation by User

Owing to the perishable and freshly prepared nature of our food products, the following cancellation policy applies:

  • You may cancel your Order before `1 day of placing it and before meal preparation has commenced.

  • Cancellations requested before 6 hours of Order placement, or after meal preparation has begun, shall not be eligible for a refund.

  • For subscription Meal Plans, cancellation requests must be submitted at least 24 (twenty-four) hours before the next scheduled delivery to avoid being charged for that delivery.

8.2 Cancellation by Kefilo

Kefilo may cancel an Order in the following circumstances, and shall notify you promptly:

  • Unavailability of ingredients or menu items;

  • Inability to deliver to your address due to logistical constraints or Force Majeure;

  • Detection of fraudulent or suspicious payment activity;

  • Breach of these Terms by the User.

In the event Kefilo cancels your Order for reasons attributable to Kefilo, a full refund shall be processed to the original payment method within 5-7 (five to seven) business days.


8.3 Refund Policy

Refunds shall be processed in the following circumstances:

  • Wrong Order Delivered: If the meal delivered is materially different from what you ordered, you are eligible for a full refund or replacement, subject to reporting the issue within 2 (two) hours of delivery with photographic evidence.

  • Tampered or Damaged Packaging: If the packaging of your Order is visibly tampered or damaged at the time of delivery, you may refuse delivery and request a full refund.

  • Missing Items: If items are missing from your Order, you shall be entitled to a proportionate refund for the missing items upon verification.

  • Non-Delivery: If your Order is not delivered within the estimated delivery window due to causes attributable to Kefilo, you shall be eligible for a full refund.


Refunds shall be credited to the original payment instrument used for the transaction. For cash-on-delivery orders, refunds shall be processed via bank transfer or platform wallet credit, as mutually agreed. Kefilo's decision on refund eligibility shall be final and binding, subject to applicable consumer protection laws. Refunds shall not be granted on the basis of personal taste preference or dissatisfaction with meal choices made by the User.


  1. Payments

All payments for Orders placed on the Platform must be made in Indian Rupees (INR) through the following accepted payment methods:

  • Credit cards and debit cards (Visa, Mastercard, RuPay, and other supported networks);

  • Net banking;

  • Unified Payments Interface (UPI);

  • Mobile wallets supported on the Platform;

  • Cash on delivery (where available and applicable).


Payments are processed through RBI-compliant, third-party payment gateways. Kefilo does not store your credit/debit card details on its servers. By making a payment, you authorise Kefilo and its payment partners to process your payment in accordance with the Order details. In the event of a failed transaction, the amount shall be automatically reversed to your bank account or payment instrument within 5-7 business days, as per banking timelines. Kefilo shall not be responsible for delays caused by your bank or payment processor.


Any dispute relating to payments must be reported to Kefilo customer support within 7 (seven) days of the transaction date. Failure to do so may result in Kefilo being unable to investigate the dispute. Subscription plans may auto renew unless cancelled. By subscribing, you authorise recurring payments. Users are responsible for managing cancellations before billing cycle and no refunds will be or are granted for mid-cycle cancellations unless legally required.


Delivery Terms

Kefilo shall use reasonable efforts to deliver your Order within the estimated delivery window communicated at the time of Order confirmation. Delivery timelines are estimates and are subject to traffic conditions, weather, and other factors beyond our control.

You agree to:

  • Ensure that the delivery address provided is accurate and complete;

  • Be available at the delivery address or make appropriate arrangements for receipt of the Order;

  • Not demand delivery to locations outside the serviceable area designated on the Platform.


Kefilo shall not be liable for failed deliveries due to inaccurate addresses, unavailability of the recipient, restricted access to the delivery location, or other circumstances attributable to the User. Kefilo reserves the right to charge a re-delivery fee in such cases. Risk and title to the food products shall pass to you upon delivery. Once the Order is accepted by you at the point of delivery, Kefilo's responsibility for the physical condition of the product ceases.


User Conduct and Prohibited Activities

By using the Platform, you agree not to engage in any of the following prohibited activities:

  1. Using the Platform for any unlawful purpose or in violation of any applicable Indian law or regulation;

  2. Submitting false, misleading, or fraudulent information in any form on the Platform;

  3. Attempting to gain unauthorised access to any part of the Platform, other users' accounts, or Kefilo's internal systems;

  4. Introducing, uploading, or transmitting any virus, malware, ransomware, spyware, or any other harmful code to the Platform;

  5. Using any automated tool, bot, scraper, or spider to access, extract data from, or interact with the Platform without our express written consent;

  6. Reproducing, copying, selling, reselling, or exploiting any part of the Platform or Services for commercial purposes without prior written authorisation from Kefilo;

  7. Posting or transmitting any content that is defamatory, abusive, obscene, sexually explicit, hateful, discriminatory, or in violation of any third-party rights;

  8. Impersonating any person or entity, including Kefilo staff or representatives;

  9. Engaging in any activity that disrupts or interferes with the proper functioning of the Platform or the experience of other users;

  10. Placing bulk, speculative, or fraudulent Orders, or abusing promotional offers, discount codes, or referral programmes.


Kefilo reserves the right to take all necessary legal action against any User who violates these provisions, including reporting to law enforcement authorities and pursuing civil or criminal remedies under applicable Indian law, including the Information Technology Act, 2000 and the Bhartiya Nyaya Sahita, 2023.

Any rewards, referral benefits, or promotional incentives offered by Kefilo shall have no monetary value and shall not be transferable. Kefilo reserves the right, at its sole discretion, to modify, suspend, or withdraw such programmes at any time without prior notice. Any misuse, abuse, or fraudulent activity in relation to such programmes may result in suspension or termination of the user account, along with appropriate legal action where applicable.


Intellectual Property Rights

All content, features, and functionality on the Platform — including but not limited to the Kefilo name, logo, trade dress, brand identity, text, graphics, photographs, meal designs, nutritional content, recipes, educational articles, videos, software, and source code — are the exclusive intellectual property of Kefilo or its licensors, and are protected under applicable Indian intellectual property laws, including the Copyright Act, 1957, the Trade Marks Act, 1999, and the Information Technology Act, 2000.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform and its Content for personal, non-commercial purposes only. This licence does not include the right to:

  • Reproduce, duplicate, copy, or sell any part of the Platform or its Content;

  • Modify, adapt, translate, or create derivative works based on the Platform or its Content;

  • Use any Kefilo trademarks, logos, or brand elements without our prior written consent;

  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices on the Platform.


Kefilo may provide limited access to certain APIs, dashboards, or technology tools to partners or authorised users on a non-exclusive, non-transferable, and revocable basis. Such access shall be used solely for permitted purposes, and users shall not reverse engineer, extract, scrape, or otherwise misuse any part of the Platform or its underlying technology. All rights, title, and interest in such technology shall remain exclusively with Kefilo. Any unauthorised use of Kefilo’s intellectual property is strictly prohibited and may result in legal action. All rights not expressly granted herein are reserved by Kefilo.


User-Generated Content

The Platform may allow you to submit reviews, feedback, ratings, comments, photographs, or other content ("User Content"). By submitting User Content, you:

  • Represent that you own or have the necessary rights and permissions to submit such content;

  • Grant Kefilo a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, display, distribute, and adapt your User Content for the purposes of operating, promoting, and improving the Platform and Services;

  • Agree that your User Content shall not be false, defamatory, obscene, illegal, or in violation of any third-party rights.


Kefilo does not endorse any User Content and shall not be responsible for the accuracy, completeness, or legality of content submitted by users. Kefilo reserves the right to remove any User Content that violates these Terms or is otherwise objectionable, without prior notice.


Disclaimer of Warranties

THE PLATFORM AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW. KEFILO EXPRESSLY DISCLAIMS:

  • Any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance;

  • Any warranty that the Platform will be uninterrupted, timely, error-free, or free from viruses or other harmful components;

  • Any warranty regarding the accuracy, completeness, or reliability of any content, nutritional information, or health guidance available on the Platform;

  • Any warranty regarding the quality, freshness, or fitness for consumption of meal products after delivery and acceptance by the User.


Kefilo does not warrant that the health outcomes or fitness goals communicated by you shall necessarily be achieved through the use of our Services. Individual results may vary based on personal health conditions, lifestyle factors, and adherence to recommended plans.

From time to time, Kefilo may introduce certain features or services on an experimental or beta basis. Such features are provided on an “as is” and “as available” basis without any warranties of any kind, and may be modified, restricted, or discontinued at Kefilo’s sole discretion. Kefilo shall not be liable for any loss, inaccuracy, or disruption arising from the use of such features.


Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW, KEFILO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH:

  • Your use of or inability to use the Platform or Services;

  • Any error, omission, interruption, or delay in the Platform's operation;

  • Unauthorised access to or alteration of your data;

  • AI recommendation errors, Health interpretation issues, Partner-related failures and Device/tech malfunctions and any consequence faced due to undisclosed conditions such as allergies by the user

  • Any third-party conduct or content accessible through the Platform;

  • Any food-related health issues arising after delivery and acceptance, except where proven to be caused by our negligence.


In no event shall Kefilo's total aggregate liability to you for all claims arising under or in connection with these Terms exceed the amount paid by you for the specific Order or Service giving rise to the claim in the 3 (three) months immediately preceding the claim. Nothing in these Terms shall limit Kefilo's liability for

(a) death or personal injury caused by Kefilo's gross negligence;

(b) fraud or fraudulent misrepresentation; or

(c) any liability that cannot be excluded or limited under applicable Indian law, including the Consumer Protection Act, 2019.


Indemnification

You agree to indemnify, defend, and hold harmless Kefilo and its directors, officers, employees, agents, partners, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Platform or Services in violation of these Terms;

  • Your violation of any applicable Indian law or regulation;

  • Your infringement of any third-party rights, including intellectual property rights or privacy rights;

  • Any false or misleading information provided by you on the Platform;

  • Any dispute between you and another user or a Partner arising from your use of the Services.


Third- Party Links and Services

The Platform may contain links to third-party websites, applications, or services, including payment gateways, social media platforms, Partner portals, and nutritional resource websites. These links are provided for convenience only.

Kefilo does not endorse, control, or accept responsibility for the content, privacy practices, or terms of any third-party website or service. Your use of any third-party website or service is entirely at your own risk and is governed by the terms and privacy policy of such third party. Kefilo shall not be liable for any loss or damage arising from your interaction with third-party websites or services.


Consumer Rights and Grievance Redressal

Kefilo is committed to upholding your rights as a consumer under the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020. As a consumer, you are entitled to:

  • Receive goods and services that conform to the description and quality advertised on the Platform;

  • A fair and transparent refund and return process;

  • Grievance redressal through our Grievance Officer within a reasonable time;

  • Access to consumer forums and regulatory authorities if your grievance is not satisfactorily resolved.


If you have any complaint, grievance, or concern regarding the Services, quality of meals, delivery, billing, or any other matter, please contact our Grievance Officer as detailed in Section 20 of these Terms. We shall acknowledge your grievance within 48 (forty-eight) hours and endeavour to resolve it within 30 (thirty) days. If your grievance is not resolved to your satisfaction, you may approach the National Consumer Helpline (NCH) at 1800-11-4000, the Consumer Disputes Redressal Commission in your jurisdiction, or the e-DAAKHIL portal at edaakhil.nic.in.


Food Safety and Quality Assurance

Kefilo is committed to maintaining the highest standards of food safety, hygiene, and quality in accordance with the Food Safety and Standards Act, 2006 (FSSAI) and the regulations framed thereunder. All our food products are prepared in FSSAI-compliant kitchen facilities. However, you acknowledge and agree that:

  • Kefilo cannot guarantee that its products are entirely free from allergens. If you have known food allergies, intolerances, or specific dietary restrictions, you must disclose them at the time of placing your Order and confirm with our team before consumption.

  • The nutritional information provided on the Platform is approximate and may vary based on ingredient availability and preparation methods. Such information should not be relied upon for the management of specific medical conditions without professional medical advice.

  • Kefilo is not responsible for any adverse health effects arising from the consumption of our products by individuals with undisclosed medical conditions or allergies.

  • Once a delivered Order is accepted by the User, responsibility for proper storage and timely consumption rests with the User. Kefilo shall not be liable for any health consequences arising from improper storage or delayed consumption.


Amendments to These Terms

Kefilo reserves the right to modify, update, or replace these Terms at any time, at its sole discretion. Updated Terms shall be posted on the Platform with a revised effective date. Where the changes are material, Kefilo shall make reasonable efforts to notify you via email or a prominent notice on the Platform. Your continued use of the Platform or Services after the updated Terms are posted shall constitute your acceptance of the revised Terms.

If you do not agree with any amendment to these Terms, you must stop using the Platform immediately and may request deletion of your account. It is your responsibility to review these Terms periodically. Kefilo shall not be liable for your failure to stay informed of any updates.

Force Majeure

Kefilo shall not be held liable for any failure or delay in the performance of its obligations under these Terms if such failure or delay results from a Force Majeure Event, including but not limited to acts of God, pandemics, epidemics, government-imposed restrictions, civil commotion, labour disputes, natural disasters, power outages, cyberattacks, or breakdown of telecommunications or supply chains.

In the event of a Force Majeure situation, Kefilo shall notify you as soon as reasonably practicable and shall use reasonable efforts to resume performance as soon as the Force Majeure Event subsides. Pre-paid amounts for Orders or Meal Plans that cannot be fulfilled due to a Force Majeure Event shall be refunded to you within a reasonable time.


Governing Law, Jurisdiction, and Dispute Resolution

23.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, including but not limited to:

  • The Indian Contract Act, 1872;

  • The Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020;

  • The Information Technology Act, 2000 and rules thereunder;

  • The Food Safety and Standards Act, 2006;

  • The Digital Personal Data Protection Act, 2023;

  • The Copyright Act, 1957 and the Trade Marks Act, 1999.

23.2 Jurisdiction

Subject to Section 22.3 below, all disputes arising out of or in relation to these Terms shall be subject to the exclusive jurisdiction of the courts located in __________, ________, India.

23.3 Dispute Resolution

In the event of any dispute or claim arising out of or relating to these Terms or the Services, both parties shall first attempt to resolve the matter amicably through good-faith negotiation. If the dispute is not resolved within 30 (thirty) days of written notice by either party, the dispute may be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. Miscellaneous

24.1 Entire Agreement

These Terms, together with the Privacy Policy and any other guidelines or policies referenced herein, constitute the entire agreement between you and Kefilo with respect to your use of the Platform and Services, and supersede all prior discussions, agreements, and understandings on the same subject matter.

24.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or severed from the Terms without affecting the validity and enforceability of the remaining provisions.

24.3 Waiver

Kefilo's failure to enforce any right or provision of these Terms at any time shall not constitute a waiver of that right or provision. Any waiver must be made in writing and signed by an authorised representative of Kefilo to be effective.

24.4 Assignment

You may not assign or transfer your rights or obligations under these Terms to any third party without Kefilo's prior written consent. Kefilo may assign its rights and obligations under these Terms to any affiliated entity or in connection with a merger, acquisition, or sale of its business assets.

24.5 Relationship of Parties

Nothing in these Terms shall be construed to create a partnership, joint venture, agency, employment, or franchise relationship between you and Kefilo. Both parties are independent parties.

24.6 Language

These Terms are issued in the English language. In the event of any conflict between an English version and any translated version of these Terms, the English language version shall prevail.
